Terms of Use
Version 1.0 · Last updated:
These terms cover your use of this website only. The website provides general information about Rainbow Pay and its services; it is not an offer of services and does not create a merchant relationship. Actual payment services are governed by separately executed merchant or service agreements.
1. About these terms
This website (rainbowpay.hk) is operated by RAINBOW PAY LIMITED (彩虹匯有限公司), a company incorporated in Hong Kong under company number 3040501, with its registered address at Room 706A, 7/F, Mirror Tower, 61 Mody Road, Tsim Sha Tsui, Kowloon, Hong Kong ("Rainbow Pay", "we", "us" or "our").
By accessing or using this website you agree to these Terms of Use. If you do not agree, please do not use the website. If you use the website on behalf of a business, you confirm that you are authorised to accept these terms on its behalf.
2. Information only
Content on this website is provided for general information about our business and services. It is not an offer, invitation or solicitation to provide any service in any jurisdiction where doing so would be unlawful or require a licence or registration we do not hold.
Descriptions of services, payment methods, features and integrations are general. Availability of any service or payment method is subject to merchant eligibility, market availability, scheme requirements and applicable acquiring or processing arrangements, and to the terms of a merchant or service agreement.
We aim to keep the website accurate and current, but we do not warrant that all content is complete, accurate or up to date at all times.
3. No guarantee of merchant approval
Submitting an enquiry or application through this website does not mean that we, or any of our payment partners, will accept a business as a merchant. Every application is subject to our onboarding and due diligence process, to the requirements of our payment partners and payment schemes, and to applicable law. We may decline an application at our discretion and are not always able to give reasons.
4. No financial, legal or tax advice
Nothing on this website is financial, investment, legal, tax, accounting or regulatory advice. Articles, guides and glossary entries are general explanations. You should obtain advice from appropriately qualified professionals about your own circumstances.
5. Intellectual property
The website and its content, including text, graphics, logos, trade names, software and page layout, are owned by or licensed to Rainbow Pay Limited. They are protected by copyright, trade mark and other intellectual property laws.
You may view and print pages for your own business reference. You may not otherwise copy, reproduce, modify, distribute, publish or create derivative works from the website or its content without our prior written permission. Card scheme and wallet names and logos shown on the website belong to their respective owners and are used only to identify payment methods.
6. Permitted use
You may use this website only for lawful purposes: to learn about our services, to contact us, to submit an enquiry or application on behalf of a business, and to read our published documentation.
7. Prohibited use
When using this website you must not:
- use it in any way that breaches applicable law or regulation, or for any fraudulent purpose;
- submit information that is false or misleading, or that you are not entitled to provide, including information about another person or business;
- attempt to gain unauthorised access to the website, its servers or any connected system or data;
- introduce malware, or interfere with or disrupt the operation or security of the website;
- use automated means to access, scrape or collect content or data from the website, except for search engine indexing consistent with our robots directives;
- send unsolicited commercial communications through our forms; or
- impersonate any person or business, or misrepresent your affiliation with any person or business.
Good-faith security research conducted in line with our Responsible Security Disclosure policy is addressed in that policy.
8. Third-party links
The website may link to websites operated by others, such as government registers, payment schemes and service providers. We provide these links for convenience. We do not control and are not responsible for third-party websites, their content or their privacy practices, and a link does not imply endorsement.
9. API documentation
Our developer documentation at docs.rainbowpay.hk (opens in a new tab) is a technical reference to help merchants and developers understand and integrate with our services. It describes interfaces and behaviour as they stand at the time of publication and may change without notice.
The documentation is not an offer of services, does not grant access to any production system and does not form part of a merchant or service agreement unless that agreement expressly incorporates it. Access to our API, credentials and environments is provided only under a separately executed agreement.
10. Website availability
We do not guarantee that the website, or any part of it, will be available at all times or free from errors or interruption. We may suspend, withdraw or change any part of the website without notice, for example for maintenance, security or business reasons.
Commitments about the availability of our payment services, if any, are set out only in the applicable merchant or service agreement.
11. Limitation of liability
To the fullest extent permitted by applicable law, the website and its content are provided on an "as is" and "as available" basis, and we exclude all warranties and representations, whether express or implied, relating to the website.
To the fullest extent permitted by applicable law, we are not liable for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty or otherwise, arising from or in connection with use of, or inability to use, the website or reliance on its content. This includes indirect or consequential loss, and loss of profits, revenue, business, goodwill or data.
Nothing in these terms excludes or limits any liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, or for fraud.
12. Indemnity
To the extent permitted by applicable law, you agree to indemnify us against claims, losses and reasonable costs arising from your breach of these terms or your unlawful use of the website.
13. Privacy and cookies
Our Privacy Notice explains how we handle personal data submitted through the website, and our Cookie Policy explains the cookies we use.
14. Changes to these terms
We may revise these terms from time to time. The version number and effective date are shown at the top of this page. Revised terms apply to use of the website from the date they are published, so please check this page when you use the website.
15. General
If any provision of these terms is found to be invalid or unenforceable, the remaining provisions continue in effect. A failure or delay by us in enforcing any provision is not a waiver of our rights. A person who is not a party to these terms has no right under the Contracts (Rights of Third Parties) Ordinance (Cap. 623) to enforce any of them.
16. Governing law and jurisdiction
These terms, and any dispute or claim arising out of or in connection with them or with the website, are governed by the laws of the Hong Kong Special Administrative Region.
The courts of the Hong Kong Special Administrative Region have jurisdiction to settle any such dispute or claim.
